1. Agreement. These Terms govern your use of GoAskSam, including Market Check, Find, Sell, Tasks, the Feedback form, our emails, and every page and feature connected to them (together, the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Who may use the Services. You must be at least 18 years old and able to form a binding contract. If you use the Services for a business, you confirm you can bind it.

3. Beta. The Services are in beta. Features, limits and results may change, break or be withdrawn at any time, with or without notice.

4. What GoAskSam is, and what it is not. GoAskSam is an information service. We report what comparable cars have sold for and show live cars that appear to fit what you asked for. We are not an appraiser, valuer, broker, dealer, auctioneer, agent, marketplace, lender, insurer or adviser of any kind. Nothing in the Services is an appraisal, a valuation, an offer, a quote, a guarantee of price, a recommendation to buy, bid, sell or hold, or financial, investment, tax, insurance, legal or other professional advice. We are not a party to any sale, bid, listing or transaction. We do not sell, list, inspect or hold any vehicle, and we do not verify any car's condition, title, history, mileage, provenance, authenticity or ownership.

5. Results are estimates of evidence, not predictions. Every range, count and comparison we show is drawn from records of completed sales and live listings published by third parties. Those records can be incomplete, late, wrong, changed or removed. A sale shows what one car brought on one day. Your car, or a car you are thinking of buying, can be worth more or less for reasons we cannot see, including condition, history, options, color, documentation, location, timing and who happens to be bidding. Figures in other currencies are converted at the exchange rate for the month of the sale. Where the records are thin, we say so, and we may show nothing. A result is never a promise of what a car will sell for, or be worth, in the future. All information in the Services, including sales records, prices, bids, photos, specifications, descriptions, counts, ranges, comparisons and any text written by or through Sam, is for general information only. Part of it comes from third parties we do not control, and all of it is provided without any warranty or promise of accuracy, completeness, timeliness or fitness for any purpose. We have no duty to verify, update or correct it, to tell you when it changes, or to monitor any listing or sale, and we may add, change or remove information at any time. Matching and set aside decisions are made by automated rules and can be wrong, including treating a sale as comparable when it is not, or setting aside a sale that was. You use all information entirely at your own risk.

6. Live cars. Live listings come from third parties. A listing can change, end, sell or be withdrawn at any moment, and the price, bid, photos and details we show may be out of date. Always check the listing itself and ask the seller or platform before you rely on anything about a car. Listed prices and bids may not include fees, premiums, taxes, shipping or other costs.

7. You are responsible for your decisions. You alone decide whether to buy, bid, sell, list, price, hold or walk away. You agree not to rely on the Services as the only basis for any decision, and to do your own research and take your own advice before you spend or commit money. You confirm that you have not relied on any statement, figure, range, result or other information from the Services as a promise or representation of any kind.

8. Accounts and sign-in. You sign in with your email address. Give us an accurate address, keep your access secure, and do not share it. You are responsible for what happens under your account. We may limit the number of accounts, Tasks or requests, and may change those limits.

9. Tasks and emails. A Task asks us to keep looking and to email you when a car appears to fit. We do not promise that we will find a car, find it in time, find every car that fits, or send an email at any particular time. Emails can be delayed, filtered or missed. By creating a Task you agree to receive emails about it. You can pause or stop a Task, and every Task email says how.

10. License to you. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial purposes. You may share an individual result with others for non-commercial purposes if you credit GoAskSam. All other use needs our written permission. If you want to use GoAskSam for a business, get in touch first.

11. What you may not do. You may not, and may not let anyone else:

  • use any robot, spider, crawler, scraper, script, bot, browser automation or other automated means to access the Services or to collect, copy, index or extract their content or data, whether or not it is on a page you can see;
  • copy, harvest or systematically download results, sales, ranges, rankings, listings, matching or other outputs, in whole or in substantial part, by any means, including by repeated manual or automated queries;
  • use the Services, or anything they produce, to train, fine tune, test, benchmark or improve any machine learning, language or other AI model, or to build a dataset, product or service that competes with or substitutes for the Services;
  • reverse engineer, decompile or try to discover our methods, rules, code, models or algorithms, or to probe, scan or test the Services for weaknesses;
  • resell, license, sublicense, republish, redistribute or commercially exploit the Services or their outputs;
  • get around any limit, rate control, access control, sign-in or security measure, or use any part of the Services that is not meant for you;
  • overload, interfere with or damage the Services, or send malware or unlawful content;
  • impersonate anyone, or give false information;
  • use the Services in breach of any law or anyone's rights.

We may block, limit or end access, and take legal action, if we think you have broken this section.

12. Our rights. The Services and everything in them, including our market engine, methods, matching rules, rankings, compiled data, text, design, software and the names GoAskSam, Sam and The Daily Vroom, belong to us or our licensors and are protected by law. We reserve every right we do not expressly give you. Names, logos and listings that belong to others remain theirs. We use them only to identify what a result is about. They do not mean that anyone sponsors, endorses or is connected with us.

13. What you send us. You keep ownership of what you send us, such as car details or feedback. You give us a worldwide, royalty free, perpetual license to use it to run, protect and improve the Services. Do not send anything you do not have the right to send, anything unlawful, or anything confidential or sensitive. We are free to use any feedback or idea you give us without paying or crediting you.

14. Third parties. The Services refer to, and link to, sites, platforms, sellers, auction houses and services that we do not own or control. We are not responsible for them, for what they say, or for what you do with them. Their own terms apply to you.

15. Disclaimer of warranties. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, OR THAT ANY RESULT, RANGE, COUNT OR LISTING IS CORRECT.

16. Limit of our liability. TO THE FULLEST EXTENT THE LAW ALLOWS, GOASKSAM AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE, SALE, BID, DEAL, VALUE, DATA, OPPORTUNITY OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN. THIS INCLUDES ANY LOSS FROM A DECISION TO BUY, BID, SELL, LIST, PRICE OR HOLD A VEHICLE, OR FROM A WRONG, MISSING, LATE OR CHANGED RESULT OR LISTING. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). YOUR ONLY REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THEM. Some places do not allow some of these limits, so some may not apply to you.

17. You will cover us. You agree to defend, indemnify and hold harmless GoAskSam and its owners, officers, employees, contractors and licensors from any claim, loss, liability, cost or expense, including reasonable legal fees, that comes from your use of the Services, what you send us, your breach of these Terms, or your breach of anyone's rights.

18. Suspension and ending. We may suspend, limit or end your access, or any part of the Services, at any time, with or without notice and without liability, including if we think you have broken these Terms. You may stop using the Services at any time. Sections that by their nature should continue after that, including 5, 7, 11 to 17 and 19 to 21, continue.

19. Disputes, and how we settle them.

  • Talk first. Before starting a formal claim, send a written notice to feedback@goasksam.com saying what the problem is and what you want. Give us 30 days to try to resolve it.
  • Individual arbitration. If we cannot resolve it, any dispute related to these Terms or the Services will be resolved only by final, binding arbitration of your individual claim, run by the American Arbitration Association (AAA) under its rules. The arbitration will be held in Wilmington, Delaware or by video. This applies to any claim whenever it arose.
  • No class actions. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine claims or award relief to anyone but the person bringing the claim.
  • Exceptions. Either of us may go to small claims court for a claim within its limit. We may go to court at any time to stop misuse of our intellectual property, or a breach of section 11.
  • Opt out. You may opt out of arbitration and the class action waiver by emailing feedback@goasksam.com within 30 days of first using the Services, with the words "Opt out" and your sign-in email address.
  • Jury waiver. To the extent the law allows, each of us waives any right to a jury trial.
  • Law and courts. These Terms and any dispute are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Any dispute that is not arbitrated, or that is brought under an exception above, must be filed only in the state or federal courts in the State of Delaware, and you agree to those courts. Any claim must be brought within one year after it arose, or it is barred, to the extent the law allows.

20. Changes. We may change these Terms or the Services at any time. The new Terms apply from the date shown at the top. Where a change matters to you, we will tell you in the Services or by email. If you keep using the Services after a change, you accept it.

21. General. These Terms and the Privacy Policy are the whole agreement between you and us about the Services. If a part is found unenforceable, the rest stays in force. If we do not enforce a right, we have not given it up. You may not transfer your rights under these Terms. We may. We are not responsible for delay or failure caused by anything outside our reasonable control. We may give you notices by email, in the Services or by posting them on this page.
